1. Acceptance of Terms

Welcome to DEADMONG Bank. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("Customer," "You," "Your") and DEADMONG Bank ("Bank," "We," "Us," "Our").

By opening an account, accessing our website, using our mobile applications, or utilizing any of our banking services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any additional terms specific to particular services.

Important Notice

If you do not agree to these Terms, you must immediately discontinue use of all DEADMONG Bank services and close any accounts. Continued use constitutes acceptance of these Terms and any future modifications.

2. Eligibility Requirements

To open an account and use DEADMONG Bank services, you must meet the following requirements:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Be a legal resident of the United States or authorized to conduct business in the U.S.
  • Provide accurate, complete, and current identification and contact information
  • Have a valid Social Security Number or Tax Identification Number
  • Not be prohibited from banking services under U.S. law or international sanctions
  • Pass identity verification and credit screening processes

Custodial accounts for minors may be opened by parents or legal guardians who assume full responsibility for account activity and compliance with these Terms.

3. Account Opening & Management

3.1 Account Application: All account applications are subject to approval. We reserve the right to deny any application without stating a reason. Approval is not guaranteed and is based on creditworthiness, identity verification, and regulatory compliance.

3.2 Account Information: You agree to provide accurate, truthful, and complete information during account opening and to update this information promptly when changes occur. Failure to maintain current information may result in account restrictions or closure.

3.3 Account Security: You are responsible for:

  • Maintaining confidentiality of passwords, PINs, and security credentials
  • Notifying us immediately of any unauthorized access or suspicious activity
  • Using strong passwords and enabling multi-factor authentication
  • Securing devices used to access your accounts
  • Not sharing login credentials with any third party

3.4 Joint Accounts: For joint accounts, each account holder has full authority to conduct transactions, withdraw funds, and modify account settings. All joint account holders are jointly and severally liable for any negative balance or obligations.

3.5 Account Statements: Monthly statements will be provided electronically unless you opt for paper statements (additional fees may apply). You must review statements within 30 days and report any discrepancies immediately.

4. Deposits & Transactions

4.1 Deposit Availability: Funds deposited may be subject to hold periods as outlined by federal regulations. Immediate availability is not guaranteed for all deposits.

4.2 Transaction Authorization: By initiating a transaction, you authorize DEADMONG Bank to process the transaction and debit your account. All transactions are subject to verification and fraud detection screening.

4.3 Electronic Transfers: ACH transfers, wire transfers, and electronic payments are subject to daily and monthly limits. Processing times vary by transfer type and may take 1-5 business days.

4.4 Reversals & Chargebacks: We reserve the right to reverse transactions in cases of:

  1. Suspected fraud or unauthorized activity
  2. Insufficient funds or returned deposits
  3. Technical errors or processing mistakes
  4. Violation of these Terms or applicable law

FDIC Insurance Coverage

Deposits at DEADMONG Bank are insured by the Federal Deposit Insurance Corporation (FDIC) up to $250,000 per depositor, per account ownership category. This protection covers checking accounts, savings accounts, money market accounts, and certificates of deposit (CDs).

5. Fees & Charges

DEADMONG Bank charges fees for various services as outlined in our Fee Schedule, available on our website and upon request. Common fees include:

  • Monthly Maintenance Fees: May be waived with minimum balance requirements
  • Overdraft Fees: Charged when transactions exceed available balance
  • Wire Transfer Fees: Domestic and international wire fees apply
  • ATM Fees: Out-of-network ATM usage may incur charges
  • Paper Statement Fees: Electronic statements are free; paper statements may have monthly fees
  • Returned Item Fees: Charged for returned checks or ACH items
  • Stop Payment Fees: Fee for stopping payment on checks or recurring debits

Fees are subject to change with 30 days' notice. Updated Fee Schedules will be posted on our website and sent to your registered email address.

Overdraft Protection: We offer optional overdraft protection services. Enrollment constitutes agreement to pay associated fees. Overdraft coverage is a privilege, not a right, and may be revoked at any time.

6. Interest & Account Benefits

6.1 Interest Rates: Interest rates on savings accounts, certificates of deposit, and other interest-bearing accounts are variable and subject to change without notice. Current rates are available on our website and in-branch.

6.2 Interest Calculation: Interest is calculated using the daily balance method and compounded monthly unless otherwise specified. Interest accrues from the day of deposit for collected funds.

6.3 Minimum Balance Requirements: Some accounts require minimum balances to earn interest or avoid fees. Falling below the minimum may result in reduced interest rates or monthly charges.

7. Loans & Credit Services

7.1 Loan Applications: All loan applications are subject to credit approval. Loan terms, interest rates, and conditions are determined based on creditworthiness, income verification, and collateral (if applicable).

7.2 Repayment Obligations: Borrowers are obligated to make timely payments according to the loan agreement. Late payments may result in:

  • Late payment fees and penalties
  • Negative credit reporting to credit bureaus
  • Increased interest rates on variable-rate loans
  • Acceleration of the loan (full balance due immediately)
  • Collection actions and legal proceedings

7.3 Prepayment: Most loans may be prepaid without penalty, though some loan products may have prepayment fees as disclosed in the loan agreement.

7.4 Default & Collections: In the event of default, DEADMONG Bank may pursue collection activities including, but not limited to, reporting to credit bureaus, engaging collection agencies, filing lawsuits, and seeking judgments. You are responsible for all collection costs, attorney fees, and court expenses.

8. Digital Services & Technology

8.1 Online & Mobile Banking: Our digital banking platforms provide convenient account access. You agree to:

  • Use secure internet connections (avoid public Wi-Fi for banking)
  • Keep software and apps updated to the latest versions
  • Install and maintain antivirus and security software
  • Log out completely after each session
  • Not jailbreak or root devices used for mobile banking

8.2 Third-Party Integrations: When linking external accounts (Chase, Bank of America, Wells Fargo, etc.), you authorize DEADMONG Bank to access account information through secure APIs. We use OAuth 2.0 authentication and never store your external bank login credentials.

8.3 System Availability: While we strive for 24/7 availability, digital services may be temporarily unavailable due to maintenance, updates, or technical issues. We are not liable for losses resulting from service interruptions.

8.4 Communication: By providing your email address and phone number, you consent to receive electronic communications including account alerts, promotional materials, and service updates. You may opt-out of marketing communications at any time.

9. Limitation of Liability

DEADMONG Bank's liability is limited to the fullest extent permitted by law:

Liability Disclaimer

DEADMONG BANK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICES.

9.1 Unauthorized Transactions: If you notify us within 2 business days of discovering unauthorized transactions, your liability is limited to $50. After 2 business days but within 60 days, liability may increase to $500. After 60 days, you may be liable for all unauthorized transactions.

9.2 Force Majeure: We are not liable for failures or delays caused by events beyond our reasonable control, including natural disasters, power outages, telecommunications failures, cyberattacks, government actions, labor disputes, or acts of war or terrorism.

9.3 Third-Party Services: We are not responsible for the actions, errors, or omissions of third-party service providers, including payment processors, card networks, ATM operators, or linked financial institutions.

10. Indemnification

You agree to indemnify, defend, and hold harmless DEADMONG Bank, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney fees) arising from:

  1. Your violation of these Terms of Service
  2. Your violation of any law or regulation
  3. Your violation of any third-party rights, including intellectual property rights
  4. Any fraudulent or illegal activity associated with your account
  5. Your failure to maintain account security or report unauthorized access

11. Dispute Resolution & Arbitration

11.1 Informal Resolution: Before initiating any formal proceeding, you agree to first contact our Customer Service Department to attempt to resolve any dispute informally.

11.2 Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your relationship with DEADMONG Bank shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.

11.3 Arbitration Rules: Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision is final and binding, and judgment may be entered in any court of competent jurisdiction.

11.4 Class Action Waiver: YOU AND DEADMONG BANK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out Right

You have the right to opt-out of arbitration by sending written notice to DEADMONG Bank within 30 days of account opening. Without this opt-out, you are agreeing to resolve disputes through binding arbitration.

12. Account Closure & Termination

12.1 Voluntary Closure: You may close your account at any time by contacting Customer Service or visiting a branch. Outstanding balances, fees, and obligations must be settled before closure is finalized.

12.2 Involuntary Closure: DEADMONG Bank reserves the right to close your account at any time, with or without cause, upon providing reasonable notice. Reasons for closure may include:

  • Violation of these Terms of Service
  • Suspected fraudulent or illegal activity
  • Extended periods of inactivity
  • Negative balance or repeated overdrafts
  • Providing false or misleading information
  • Failure to maintain required documentation
  • Abusive behavior toward bank staff

12.3 Effect of Termination: Upon account closure, you must return all bank-issued cards, checks, and access devices. Any recurring payments or deposits must be redirected. Outstanding obligations survive account closure.

13. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your data.

We comply with the Gramm-Leach-Bliley Act (GLBA), Fair Credit Reporting Act (FCRA), and other applicable privacy laws. We do not sell your personal information to third parties.

14. Intellectual Property

All content on DEADMONG Bank websites and mobile applications, including text, graphics, logos, icons, images, audio clips, video clips, and software, is the property of DEADMONG Bank or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without our express written permission. The DEADMONG Bank name and logo are registered trademarks and may not be used without authorization.

15. Regulatory Compliance

DEADMONG Bank operates in compliance with all applicable federal and state banking regulations, including:

  • Bank Secrecy Act (BSA): We are required to report certain transactions to federal authorities
  • USA PATRIOT Act: We must verify customer identities and maintain records
  • Anti-Money Laundering (AML): We monitor for and report suspicious activity
  • Office of Foreign Assets Control (OFAC): We screen against sanctions lists
  • Truth in Lending Act (TILA): We provide required disclosures for credit products
  • Equal Credit Opportunity Act (ECOA): We do not discriminate in lending

You agree to cooperate with our compliance efforts, including providing documentation and information as requested for regulatory purposes.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York and the United States, without regard to conflicts of law principles. Jurisdiction and venue for any disputes shall be in the state and federal courts located in New York County, New York.

17. Modifications to Terms

DEADMONG Bank reserves the right to modify these Terms at any time. Material changes will be communicated through:

  • Email notification to your registered email address
  • Prominent notice on our website and mobile applications
  • Written notice for significant changes affecting your rights

Your continued use of DEADMONG Bank services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must close your account before the effective date.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with the Privacy Policy and any product-specific agreements, constitute the entire agreement between you and DEADMONG Bank regarding the use of our services and supersede all prior agreements, representations, and understandings.
